These General Terms and Conditions (GTC) apply to all business relationships between our customers and Maltastisch.
I. Offer and conclusion of contract
1. Booking and conditions of participation
By booking a painting spot, a binding contract is concluded between the customer and us. The following conditions apply:
Bookings for 1 to 5 people
minimum spend of €20.00 on ceramics applies per booked painting spot. (Drinks and souvenirs are excluded from this.)
Changes to the number of people must be communicated at least 2 days before the appointment via email to maltastisch@gmail.com. Otherwise, the minimum spend per person will be charged.
Free cancellation is possible up to 2 days before the appointment via the booking link. In case of last-minute cancellations or no-shows, we charge the minimum spend of €20.00 per booked spot.
The painting time per booking is 2.5 hours (incl. instruction). If the piece is not finished within this time, a follow-up appointment (on weekdays) can be booked within 4 weeks to finish it. For this, we charge a flat rate of €5.00 per person. It must be stated at the time of booking that it is a finishing session.
Group bookings for 8 people or more
Group bookings for 8 people or more must be made exclusively via email to maltastisch@gmail.com or via our contact form.
A minimum spend of €20.00 per person applies.
A deposit of 50% of the minimum spend is due upon reservation.
You will receive payment details via email.
In case of cancellation within the deadline (up to 7 days before the appointment), the deposit will be fully refunded.
In case of cancellation later than 7 days before the appointment or in case of no-shows, the minimum spend per person will be charged.
Changes to the number of people must be communicated via email at least 2 days before the appointment.
Painting time: 2.5 hours (incl. instruction).
We recommend children’s birthday parties for ages 9 and up. Please note: Celebrations (e.g., eating cake, unwrapping gifts) cannot take place in the studio. The duty of supervision remains with the parents or accompanying persons. Unfinished pieces can also be finished within 4 weeks on a weekday (€5.00 re-booking flat rate per person).
II. Subject of the Contract
We offer ceramic blanks (bisque ware) for individual painting and provide our rooms in Sülz for this purpose. This includes ceramic blanks, paints, brushes, stencils, and other aids (subject to availability). Alternatively, a “to-go kit” can be rented upon request to paint ceramics at home. The rental process is agreed upon in advance via email, telephone, or in person. Customers undertake to treat the material with care. For the rental process, we require an address and telephone number. Data protection regulations will of course be observed. The return period for the “to-go kit” is 2–7 days (by agreement). If the studio is closed on the return day, the period is extended until the next opening day. The return takes place at the collection point. Customers agree to receive an electronic invoice via email.
III. Provided Materials
All materials provided by us (e.g., stencils, drawings, documents, digital files) remain our property and are subject to copyright. They may not be passed on to third parties or reproduced unless we have expressly agreed in writing.
IV. Prices and Payment
All quoted prices include statutory VAT. Shipping or delivery costs are not included unless otherwise agreed. Payments are made in cash or by card. There is no entitlement to card payment. In exceptional cases, a bank transfer may be agreed upon. The invoice amount is due immediately after painting. For the “to-go kit”, payment is due upon collection. In addition, a deposit of €50.00 is charged in cash, which will be fully refunded upon timely return. In case of late return, a fee of €10.00 per day becomes due, which will be offset against the deposit. If a subsequent booking is prevented by late return, we reserve the right to charge for a loss of revenue of €100.00 per missed booking.
V. Delivery Time and Completion
Unless a binding collection date has been agreed, indicated dates are non-binding. If the finished fired ceramic is not collected within 8 weeks, it becomes our property without any right to a refund. Therefore, please inform us via email or contact form in case of late collection. Statutory claims remain unaffected.
VI. Retention of Title
The painted ceramic remains our property until it has been fully paid for. Customers are obliged to treat the ceramic with care. Repairs (e.g., with superglue) are prohibited. Damage to our property must be compensated at the full purchase price. We reserve all image rights to photographs of ceramics painted with us – regardless of whether they were created in the studio or with a “to-go kit”. These rights expressly include use for advertising and publication purposes.
VII. Warranty and Defects
Illustrations, colors, and patterns serve for orientation and are not binding. Due to the manual processing and the firing process, small deviations and irregularities may occur, e.g.: small color speckles or glaze bubbles rough spots, color gradients, or minimal color deviations pinholes from pencil marks or stilt marks These phenomena do not constitute a defect. Before firing, the foot rings are cleaned or placed on stilts, which may result in small unglazed spots. Should a ceramic be damaged during our post-processing, we will replace it with a voucher or repurchase. Defects must be reported upon collection. Subsequent complaints must be brought to the studio with the affected ceramic for assessment. For ceramics painted outside our premises (“to-go kit”), we assume no warranty for glaze or firing results.
VIII. Dispute Resolution
The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
IX. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Should a provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
